Can a creditor put a repo. or any other derogatory marks on your credit report if ch 7 bankruptcy was filed?
Sonz asked:
The vehicle was included in bankruptcy and never reaffirmed. Voluntary payments are being made and are current. If the vehicle is surrendered now can they put anything else on the credit report like a reposession?

That is what they do when you do not pay the creditors…

The bankruptcy can be (and probably has been) put on the credit report.

My question would be that you may not have officially reaffirmed it but by the making the payments you may have set it up to be considered reaffirmed.
Ask your BK Lawyer.

Yes they will depending on what kind of repo you had. Was it a full repo where the agent had to come out to your home and hook and drag or was it a voluntary where you handed the unit over with the keys?
The only difference is a voluntary looks better to future creditors than a full repo does.

No.
Your credit report should read “Included in bankruptcy” for your car loan. Since you did not reaffirm this loan they are not reporting it to the credit bureaus if you let it go back nothing will change on your credit report.
When I went through my BK back in 2001 the same thing happened to me. I had 2 accounts with Ford one was my car and the other was my ex-wife’s. I reaffirmed on mine and not on hers, she made the payments for about a year and then let it go back. Nothing changed on my credit report.
